Department of Justice has constituted a Task Force under the Chairmanship of Secretary, Department of Justice for improving performance on the parameter of "Enforcing Contract" for ease of doing business in India.
The Task Force takes concerted steps to improve the pace and quality of reform process on "Enforcing Contract" parameter for ease of doing business in India.
The Task Force has members from the Department for Promotion of Industry and Internal Trade (DPIIT), Department of Legal Affairs (DoLA), the High Courts of Delhi, Bombay, Calcutta and Karnataka, the Law Departments of Delhi, Maharashtra, West Bengal and Karnataka and the eCommittee of the Supreme Court.
Twelve Task Force meetings have been held so far.
The Taskforce monitors and takes concerted steps on the pace and quality of reform process on “Enforcing Contracts” for ease of doing business in the cities of Delhi, Bombay, Calcutta and Bengaluru.
The last meeting of the Task Force was held on 16.07.2021.
• Minutes of the Twelfth Task Force Meetings
The NITI Aayog has constituted a Taskforce on Enforcement of Contracts. The aim of this Taskforce is to address risk perception in investing and to achieve policy certainty by recommending a policy framework for Enforcement of Contracts.
The present Task Force on Enforcement of Contracts is tasked with a wider mandate i.e., to review and recommend reforms for enhancing the efficacy and efficiency of justice delivery system vis-à-vis commercial disputes across the country.
The Task Force for Enforcement of Contracts has been constituted with the participation from key Ministries/Departments of the Government of India and certain State Chief Secretaries.
The Vice Chairman, NITI Aayog is the Chairman of the Task force and CEO, NITI Aayog is the Member Secretary of the Task Force. Other members include Secretary (DPIIT) ; Secretary (Department of Economic Affairs) ; Secretary (Revenue); Secretary (Department of Commerce), Secretary(Justice), Secretary(Legal Affairs) and Chief Secretary(s) of the States of Maharashtra, Gujarat, Andhra Pradesh, Tamil Nadu, Uttar Pradesh.
The target of the Task Force is to submit its report within 6 (six) months of its constitution.
Three meetings of the Task Force on Enforcement of Contracts have been held so far under the Chairmanship of Vice Chairman, Niti Aayog.
Department of Justice also holds regular Review Meetings every fortnightly to assess the progress made in respect of reforms for improving India’s ranking in the World Bank’s Doing Business Report for the “Enforcing Contracts” indicator.
The Review Meeting comprises of representatives from High Court of Delhi, Bombay, Calcutta and Karnataka, e-Committee of the Supreme Court of India, National Informatics Centre (NIC) and Invest India.
